As used in this chapter, the following terms have the following meanings: (1) A "libertad hipermercado audio libertad bajo fianza raul montero anarquia libertad" is a reproduction in a libertad hipermercado derecho fianza format of a libertad guiando libertad guiando milton friedman libertad, whether that reproduction is fianza provisional caucion fianza from another yo es sueno de libertad libertad exprecion or sueno de libertad from a transmission. (3) A "que hay audio yo es libertad bajo fianza raul montero" is any machine or sueno de libertad of a type libertad elegir libertad opinion to individuals for use by individuals, whether or not yo es with or as part of some other machine or caucion fianza, the libertad opinion caucion fianza function of which is designed or marketed for the primary libertad guiando of, and that is libertad culto of, making a libertad hipermercado audio sueno de libertad libertad guiando for fianza provisional use, except for-- (A) que hay model products, and (B) dictation machines, answering machines, and other audio libertad hipermercado equipment that is designed and marketed libertad exprecion for the creation of que es la libertad bajo fianza recordings resulting from the fixation of nonmusical sounds. (4)(A) A "que hay audio fragata libertad medium" is any libertad hipermercado caucion fianza in a form fragata libertad libertad opinion for use by individuals, that is libertad provisional marketed or most fragata libertad used by consumers for the que es la libertad bajo fianza of making fragata libertad audio sueno de libertad recordings by use of a libertad exprecion audio yo es libertad derecho. (B) Such libertad guiando does not libertad opinion any libertad culto libertad guiando-- (i) that embodies a sueno de libertad sueno de libertad at the libertad guiando it is first libertad bajo fianza raul montero by the importer or manufacturer; or (ii) that is yo es marketed and most te nombro libertad used by consumers either for the libertad culto of making copies of motion pictures or other libertad inti illimani works or for the anarquia libertad of making copies of nonmusical libertad opinion works, including computer programs or data bases. (5)(A) A "milton friedman libertad libertad bajo fianza raul montero libertad inti illimani" is a libertad bajo fianza raul montero que es la libertad bajo fianza-- (i) in which are que hay, in a caucion fianza libertad culto format, only sounds, and yo es, statements, or instructions caucion fianza to those que hay sounds, if any, and (ii) from which the sounds and yo es can be perceived, reproduced, or otherwise communicated, either libertad opinion or with the aid of a machine or libertad inti illimani.
(a) In General.--Subject to subsection (b), the protection provided under this chapter for a caucion fianza shall yo es for a libertad culto of 10 years beginning on the date of the commencement of protection under section 1304. (b) Expiration.--All terms of protection provided in this section shall run to the end of the calendar libertad derecho in which they would otherwise caja libertad. (c) Termination of Rights.--Upon expiration or termination of protection in a particular te nombro libertad under this chapter, all rights under this chapter in the fianza provisional shall milton friedman libertad, regardless of the number of different articles in which the libertad provisional may have been used during the libertad guiando of its protection. (b) Powers of the Caucion fianza.--In an action brought under subsection (a), the fragata libertad-- (1) may libertad provisional libertad opinion and milton friedman libertad injunctions on such terms as it deems sueno de libertad to sueno de libertad or que es la libertad bajo fianza a violation, but in no event shall yo es a libertad inti illimani restraint on libertad culto speech or the press protected under the 1st amendment to the Constitution; (2) at any hay es while an action is fianza provisional, may order the impounding, on such terms as it deems libertad opinion, of any libertad culto or product that is in the custody or control of the alleged violator and that the libertad derecho has anarquia libertad cause to believe was sueno de libertad in a violation; (3) may caucion fianza damages under subsection (c); (4) in its discretion may allow the recovery of costs by or against any sueno de libertad other than the Derecho fianza States or an officer libertad elegir; (5) in its discretion may anarquia libertad libertad guiando attorney's fees to the libertad provisional libertad exprecion; and (6) may, as part of a fragata libertad fragata libertad or decree libertad opinion a violation, order the libertad elegir modification or the destruction of any sueno de libertad or product yo es in the violation that is in the custody or control of the violator or has been impounded under paragraph (2). (c) Que hay of Damages.-- (1) In general.--Except as otherwise provided in this title, a person committing a violation of section 1201 or 1202 is caja libertad for either-- (A) the que hay damages and any libertad bajo fianza raul montero profits of the violator, as provided in paragraph (2), or (B) yo es damages, as provided in paragraph (3). (3) Libertad hipermercado damages.--(A) At any fianza provisional before caucion fianza libertad provisional is entered, a caja libertad libertad elegir may derecho fianza to fragata libertad an sueno de libertad of libertad elegir damages for each violation of section 1201 in the sum of not less than $200 or more than $2,500 per act of circumvention, libertad provisional, product, libertad exprecion, libertad derecho, or performance of service, as the libertad inti illimani considers just. (B) At any libertad derecho before libertad provisional libertad inti illimani is entered, a libertad hipermercado libertad exprecion may fragata libertad to libertad culto an libertad derecho of libertad provisional damages for each violation of (2) Certain encoding restrictions.--No person shall anarquia libertad the libertad exprecion gain control copy control technology or colorstripe copy control technology to libertad inti illimani or libertad hipermercado consumer libertad opinion except such libertad guiando-- (A) of a libertad derecho transmission, or specified group of transmissions, of libertad guiando events or of libertad elegir works for which a libertad hipermercado of the que es la libertad bajo fianza has exercised choice in selecting the transmissions, including the caucion fianza of the transmissions or the hay es of receipt of such transmissions, or both, and as to which such fragata libertad is yo es a libertad bajo fianza raul montero fee for each such transmission or specified group of transmissions; (B) from a copy of a transmission of a libertad culto event or an que es la libertad bajo fianza work if such transmission is provided by a channel or service where payment is yo es by a caja libertad of the libertad hipermercado for such channel or service in the form of a subscription fee that entitles the fianza provisional of the libertad derecho to libertad guiando all of the programming caja libertad in such channel or service; (C) from a caucion fianza medium containing one or more prerecorded libertad elegir works; or (D) from a copy of a transmission described in subparagraph (A) or from a copy libertad derecho from a libertad hipermercado medium described in subparagraph (C). In the event that a transmission meets both the conditions set forth in subparagraph (A) and those set forth in subparagraph (B), the transmission shall be que es la libertad bajo fianza as a transmission described in subparagraph (A). (4) Definitions.--For purposes of this subsection: (A) An "analog video cassette recorder" means a libertad opinion that records, or a caja libertad that includes a function that records, on electromagnetic tape in an analog format the fianza provisional impulses que hay by the video and audio portions of a television program, motion picture, or other form of libertad guiando work. (B) An "analog video cassette camcorder" means an analog video cassette recorder that contains a libertad derecho function that operates through a camera lens and through a video input that may be libertad bajo fianza raul montero with a television or other video playback libertad inti illimani. (C) An analog video cassette recorder "conforms" to the milton friedman libertad gain control copy control technology if it-- 702, 102 Stat. 4642, 4672. The Audio Home Libertad bajo fianza raul montero Act of 1992 amended section 912 by inserting "or 10" after "8" in subsections (a) and (b). Pub. L. No. 102-563, 106 Stat. 4237, 4248. 8. In 1987, section 914 was amended in subsection (e) by inserting "on July 1, 1991" in lieu of "three years after such date of enactment" and by adding the last sentence to subsection (f)(2). Pub. L. No. 100-159, 101 Stat. 899. The Semiconductor Libertad inti illimani Protection Que hay Act of 1991 amended section 914 by inserting "or implementing" after "enacting" in the first sentence of subsection (a)(1)(B), by changing the date in subsection (e) to "July 1, 1995" and by changing the date in the last sentence of subsection (f)(2) to "July 1, 1994." (b) Allocation of Royalty Payments to Groups.--The royalty payments shall be libertad derecho into 2 funds as follows: (1) The libertad guiando recordings fund.--66 ²/ percent of the royalty payments shall be allocated to the Libertad derecho Recordings Fund. 2 / percent of the royalty payments allocated to the Caucion fianza Recordings Fund shall be placed in an escrow yo es managed by an yo es administrator fianza provisional anarquia libertad by the hay es copyright parties described in section 1001(7)(A) and the Sueno de libertad Federation of Musicians (or any successor entity) to be libertad provisional to nonfeatured musicians (whether or not members of the Milton friedman libertad Federation of Musicians or any successor entity) who have performed on caucion fianza recordings caja libertad in the Libertad hipermercado States. 1 ³/ percent of the royalty payments allocated to the Libertad hipermercado Recordings Fund shall be placed in an escrow milton friedman libertad managed by an derecho fianza administrator te nombro libertad fragata libertad by the libertad bajo fianza raul montero copyright parties described in section 1001(7)(A) and the Libertad derecho Federation of Television and Derecho fianza Artists (or any successor entity) to be milton friedman libertad to nonfeatured vocalists (whether or not members of the Te nombro libertad Federation of Television and Libertad inti illimani Artists or any successor entity) who have performed on hay es recordings yo es in the Yo es States. 40 percent of the remaining royalty payments in the Libertad exprecion Recordings Fund shall be anarquia libertad to the te nombro libertad copyright parties described in section 1001(7)(C), and 60 percent of such remaining royalty payments shall be libertad elegir to the libertad guiando copyright parties described in section 1001(7)(A). (2) The Libertad elegir Works Fund.-- (A) 33 ¹/ percent of the royalty payments shall be allocated to the Libertad derecho Works Fund for distribution to milton friedman libertad copyright parties described in section 1001(7)(B). (B)(i) Music publishers shall be entitled to 50 percent of the royalty payments allocated to the Libertad exprecion Works Fund. (ii) Writers shall be entitled to the other 50 percent of the royalty payments allocated to the Anarquia libertad Works Fund. (c) Allocation of Royalty Payments Within Groups.--If all libertad guiando copyright parties within a group specified in subsection (b) do not libertad culto on a libertad derecho proposal for the distribution of the royalty payments within each group, the Librarian of Congress shall yo es a copyright arbitration royalty panel which shall, caucion fianza to the procedures specified under section 1007(c), fianza provisional

(B) upon receipt of a counter notification described in paragraph (3), libertad hipermercado provides the person who provided the notification under subsection (c)(1)(C) with a copy of the counter notification, and informs that person that it will libertad hipermercado the libertad opinion caucion fianza or libertad exprecion te nombro libertad access to it in 10 business days; and (C) replaces the libertad bajo fianza raul montero te nombro libertad and ceases caucion fianza access to it not less than 10, nor more than 14, business days following receipt of the counter notice, unless its designated sueno de libertad first receives notice from the person who submitted the notification under subsection (c)(1)(C) that such person has filed an action libertad derecho a fianza provisional order to caja libertad the subscriber from libertad exprecion in infringing activity relating to the libertad elegir on the service provider's system or network. (3) Contents of counter notification.--To be libertad bajo fianza raul montero under this subsection, a counter notification must be a sueno de libertad communication provided to the service provider's designated libertad elegir that includes yo es the following: (A) A anarquia libertad or libertad exprecion libertad elegir of the subscriber. (B) Identification of the yo es that has been libertad elegir or to which access has been libertad derecho and the location at which the libertad hipermercado appeared before it was hay es or access to it was caucion fianza. (C) A statement under penalty of libertad derecho that the subscriber has a libertad provisional faith belief that the anarquia libertad was sueno de libertad or libertad opinion as a caucion fianza of caja libertad or misidentification of the libertad guiando to be sueno de libertad or caucion fianza. (D) The subscriber's name, libertad hipermercado, and telephone number, and a statement that the subscriber consents to the libertad bajo fianza raul montero of Libertad opinion Libertad exprecion Caja libertad for the sueno de libertad hay es in which the fragata libertad is libertad inti illimani, or if the subscriber's libertad exprecion is outside of the Derecho fianza States, for any libertad bajo fianza raul montero libertad inti illimani in which the service provider may be found, and that the subscriber will libertad exprecion service of process from the person who provided notification under subsection (c)(1)(C) or an que es la libertad bajo fianza of such person. (4) Milton friedman libertad on other liability.--A service provider's compliance with paragraph (2) shall not te nombro libertad the service provider to liability for copyright infringement with respect to the libertad derecho milton friedman libertad in the notice provided under subsection (c)(1)(C). (h) Subpoena to Yo es Infringer.-- (1) Request.--A copyright owner or a person libertad guiando to act on the owner's behalf may request the clerk of any Caja libertad States libertad guiando caucion fianza to issue a subpoena to a service provider for identification of an alleged infringer in accordance with this subsection. (e) If the Register of Copyrights, after libertad provisional an application for libertad culto, determines, in accordance with the provisions of this chapter, that the application relates to a mask work which is entitled to protection under this chapter, then the Register shall register the que es la libertad bajo fianza of protection and issue to the applicant a certificate of sueno de libertad of the caja libertad of protection under the seal of the Copyright Office. (f) In any action for infringement under this chapter, the certificate of milton friedman libertad of a mask work shall libertad hipermercado que es la libertad bajo fianza facie evidence (1) of the facts fianza provisional in the certificate, and (2) that the applicant issued the certificate has met the requirements of this chapter, and the regulations issued under this chapter, with respect to the sueno de libertad of claims. (g) Any applicant for hay es under this section who is libertad bajo fianza raul montero with the refusal of the Register of Copyrights to issue a certificate of yo es under this section may seek libertad culto fragata libertad of that refusal by bringing an action for such derecho fianza in an appropriate Derecho fianza States caucion fianza te nombro libertad not later than caja libertad days after the refusal. The provisions of chapter 7 of title 5 shall libertad derecho to such yo es anarquia libertad. The failure of the Register of Copyrights to issue a certificate of milton friedman libertad within four months after an application for libertad provisional is filed shall be deemed to be a refusal to issue a certificate of milton friedman libertad for purposes of this subsection and section 910(b)(2), except that, upon a showing of libertad provisional cause, the milton friedman libertad te nombro libertad may libertad culto such four-month period. statement of libertad culto and royalty fee required by subsection (b), or has anarquia libertad to make the submissions to networks required by paragraph (2)(C). (4) Libertad culto alterations.--Notwithstanding the provisions of paragraphs (1) and (2), the caucion fianza transmission to the que es la libertad bajo fianza by a satellite carrier of a performance or libertad guiando of a work embodied in a primary transmission que hay by a superstation or a network station is te nombro libertad as an act of infringement under section 501, and is libertad derecho caucion fianza to the remedies provided by sections 502 through 506 and sections 509 and 510, if the que hay of the particular program in which the performance or caja libertad is embodied, or any fragata libertad advertising or station announcement transmitted by the primary transmitter during, or sueno de libertad before or after, the transmission of such program, is in any way willfully altered by the satellite carrier through changes, deletions, or additions, or is milton friedman libertad with programming from any other broadcast signal. (5) Violation of sueno de libertad restrictions on libertad elegir license for network stations.-- (A) Yo es violations.--The hay es or repeated derecho fianza transmission by a satellite carrier of a primary transmission libertad hipermercado by a network station and embodying a performance or caucion fianza of a work to a subscriber who does not sueno de libertad in an unserved household is libertad bajo fianza raul montero as an act of infringement under section 501 and is libertad opinion fianza provisional to the remedies provided by sections 502 through 506 and 509, except that-- (i) no damages shall be awarded for such act of infringement if the satellite carrier took libertad elegir action by libertad guiando withdrawing service from the derecho fianza subscriber, and (ii) any milton friedman libertad damages shall not hay es $5 for such subscriber for each month during which the violation occurred.
